1. Scope

These Terms of Service govern the contractual relationship between the operator of the web-based Software-as-a-Service application “Decision Analysis App” (hereinafter “Platform”) and registered users.

By registering and using the Platform, the user accepts these Terms of Service.

2. Operator

3. Subject Matter of the Contract

The Platform enables users to conduct and store weighted decision analyses, including the definition of criteria, weights, alternatives, and ratings.

The Platform provides a technical tool only. It does not constitute legal, financial, business, or professional advice of any kind.

No entitlement exists to specific features, future developments, or functional extensions.

4. Registration and User Account

Registration is required to use the Platform.

The user agrees to:

provide accurate and current information
keep login credentials confidential
not grant third parties access to the account

The user is responsible for all activities conducted under their account.

5. User Obligations

The user is prohibited from:

storing unlawful, offensive, or otherwise impermissible content
using the Platform for abusive or unauthorized purposes
attempting to bypass security mechanisms
performing automated access without explicit permission
manipulating, disrupting, or interfering with the Platform

The operator reserves the right to suspend or permanently delete user accounts without prior notice in case of violations.

6. Availability

The Platform is provided as a free online service.

There is no entitlement to:

uninterrupted use
permanent availability
specific response times
retention of data for a defined period

Maintenance, updates, or technical issues may result in temporary limitations or interruptions.

7. Liability

Use of the Platform is at the user’s own risk.

The Platform is provided without express or implied warranties regarding availability, error-free operation, or fitness for a particular purpose.

The operator assumes no responsibility for:

the accuracy or completeness of user-entered or calculated data,
the suitability of the Platform for business, financial, or strategic decisions,
prevention of data loss,
uninterrupted or continuous availability of the Platform.

Any decisions made based on results generated by the Platform are the sole responsibility of the user.

The Platform does not provide legal, financial, business, or other professional advice.

To the extent permitted by law, the operator’s liability is limited to damages caused intentionally or through gross negligence.

Liability for:

slight negligence,
indirect or consequential damages,
loss of profit,
data loss,
business interruption,
third-party claims

is excluded.

To the extent permitted by law, liability shall be limited in amount to the total fees paid by the user for use of the Platform during the twelve (12) months preceding the event giving rise to the claim.

The user is solely responsible for maintaining backups of their data.

8. Data Protection

Information regarding the processing of personal data is set out in the separate Privacy Policy.

9. Termination and Account Deletion

Users may delete their account at any time.

Upon deletion, all associated data will be permanently removed.

The operator reserves the right to suspend or delete user accounts in cases of misuse or violation of these Terms of Service.
